An American man from Texas named Daniel Rawls has won a lawsuit claiming a restaurant was to blame for being too drunk. That would be the reason that he ended up in a fight, resulting in a serious head injury. Rawls has been awarded a whopping $5.5 million for his claims.
The incident took place in May 2019. The restaurant, called La Fogata Mexican Grill’s, is said to have been negligent in serving alcohol, according to Rawls, as he had clearly had enough to drink. While leaving the bar, he got into a fight with another customer, who, according to the charges, had also been served too much alcohol. Rawls was said to have suffered serious head injuries in the fight in the parking lot.
Rawls argues that the owner of the restaurant, Lourdes Galindo, and an unknown bartender are responsible for the injury. He accused the bartender of not being trained enough by Galindo to detect when customers had had too much to drink and then let them leave the restaurant together. In addition, no ambulance was called after he was injured.
Finally, Rawls also claimed that Galindo should have made sure that the parking lot was safe from anything that could ” trip or fall for intoxicated customers” since an “uneven parking lot” helped make the head injury so ” serious and invalidating”.
Rawls won the lawsuit as a result of a default judgment, meaning Lourdes Galindo did not respond to the charges or attend the hearing. Rawls was subsequently awarded a total of $5.5 million for five claims. The claims include on-site liability, negligence and damages resulting from foreseeable criminal conduct. The restaurant has 30 days to appeal if it wants a new trial.
Interesting detail: Andrews County prison records show Rawls was arrested twice in February 2019 and May 2020 on charges of public intoxication.
